withstanding the legal requirement for all enclosed workplaces to be smoke
free from 1 July 2008 this Yacht Club has additionally adopted the following
policy applicable to staff, members, service users and visitors. 1. Objectives of the Policy Colne Yacht Club
has a responsibility for the protection of the safety of it’s members, staff
and visitors when on club premises and acknowledges that breathing other
people’s smoke is both a public health hazard and welfare issue. This
Policy recognises that breathing in second-hand smoke adversely affects health.
It is not concerned with whether anyone
smokes but it is the concern of the Colne Yacht
Club to ensure that it’s members, staff and
visitors are not affected whilst on club premises. Colne Yacht Club
actively encourages its employees to refrain from smoking outside the times and
circumstances set out in this policy, both in their own interests and as
representatives of a sporting club. The
policy seeks to: ·
Promote a healthy
working environment and protect the current and future health of employees,
members and visitors ·
Guarantee the right of everyone to
breathe in air free from tobacco smoke ·
Comply with Health & Safety Legislation and Employment
Law ·
Raise awareness of the dangers associated with exposure to
tobacco smoke ·
Take account of the needs of those who
choose to smoke and to support those who wish to stop 1.2
Introduction
Section 2(2) of the Health and Safety at Work Act
1974 places a duty on employers to: ‘…provide
and maintain a safe working environment which is, so far as is reasonably
practical, safe, without risks to health and adequate as regards facilities and
arrangements for their welfare at work.’ Second-hand smoke – breathing other people’s
tobacco smoke – and side stream smoke has now been shown to be a cause of lung
cancer and heart disease in non-smokers, as well as many other illnesses and
minor conditions. 2. General
Principles and Scope The aim of this Policy is to:
This Policy will apply to all staff, members,
visitors, contractors and other persons, who enter the premises of the Colne
Yacht Club. 2.1
Restrictions on Smoking Smoking
is not permitted in any part of the premises or entrances, stairways and
corridors managed, leased or owned by the Colne
Yacht Club at any time, by any person
regardless of their status or business with the organisation. 2.2
Designated smoking areas The area designated for smoking will be on the ground
floor outside the clubhouse. Smoking is not to take place within two
metres of any
doorway or entrance. Receptacles for smoker’s refuse are provided. Smoking is
permitted in the club boatyard and on the club jetty. 2.3
Visitors All
visitors, contractors and deliverers are required to abide by the smoke free
policy. Staff members are expected to inform contractors, deliverers or visitors
of the policy. However they are not expected to enter into any confrontation
that may put their personal safety at risk. 2.4
Staff Staffs
on duty are only permitted to smoke in accordance with this policy. 2.5
Vehicles Smoking is
not permitted in vehicles whilst used on Colne Yacht Club
business including the purposes for transporting staff, members or visitors. 2.6
Support for smokers The
Colne Yacht Club recognises its duty towards
employees who smoke. The National Health Service offers a support service for
those wishing to stop smoking: •
Information regarding smoking cessation methods. •
Provision of nicotine replacement therapy •
Advice and support whilst on the smoking cessation programme and post smoking
support. Information on stopping smoking
with support from local cessation services will also be provided for smokers,
both members and staff, in the Colne Yacht Club.
The NHS Smoking Helpline number can be given to members and staff which
is 0800 169 0 169.
The Helpline can offer advice and support on stopping smoking along with
a website at www.givingupsmoking.co.uk

2.7
Sales of Tobacco Products
It
is a criminal offence for anyone to sell, transport or possess illegal tobacco
products. Penalties for such offences may include imprisonment and/or fines
including fines of up to £5000 for any manager allowing their premises to be
used for such activities. The
selling/storing and dealing in any way of illegal cigarettes and tobacco on Colne
Yacht Club premises will not be tolerated. Any such illegal activity will
be considered as Gross Misconduct and will result in appropriate disciplinary
action. Colne Yacht Club
will fully
co-operate with Law Enforcement agencies, such as HM Revenue and Customs, in any
of their investigations. 3. Introduction
and implementation of the Policy
The Policy was agreed by the Colne Yacht Club General
Committee at its meeting on 25 September 2008. Its formal implementation will commence on 26
September 2008. Responsibility for implementing this Policy rests
with the Flag Officers. Day-to-day responsibility for implementation lies with
Flag Officers and members of the General Committee. To ensure that everyone
entering the Colne Yacht Club sites understands
that smoking is only allowed in designated areas away from buildings, clear
signs will be displayed. Tenders and contracts with Colne
Yacht Club will stipulate adherence to
this Policy as a contractual condition. Existing contracts will be modified as
soon as possible. Job advertisements will include reference to the
smoke free policy and indicate that adherence to it will form part of the
contract of employment. 3.1
Disciplinary Action Any
member of staff refusing to observe the policy by smoking in unauthorised areas
will be liable to Disciplinary Action in accordance with the Colne
Yacht Club’s Disciplinary Policy. In
the event of a breach of the policy by a member, visitor or staff member of
other organisations, they should be asked to extinguish all smoking materials
and be informed of the availability of external smoking areas. If they continue
to smoke the matter should be referred to a Flag Officer or a member of the
General Committee as appropriate. In the event that staff of other organisations
continue to breach the policy, the appropriate organisation should be advised in
writing of the requirements of the Colne Yacht Club and the consequences of breaching these
requirements. 3.2
Monitoring and reviewing
This
policy will be reviewed every two years to
ensure that it continues to meet the aims of the original policy.
The Smoke Free Policy Co-ordinator will be that member designated by the
General Committee. Comments
related to the maintenance of this policy should be directed to the Smoke Free
Policy Co-ordinator This
policy was adopted by the General Committee at their meeting on 26 September
2008 under their power to introduce byelaws. It will come into force 14 days

RULES
FOR CLUB JETTY
1. The Jetty is strictly for
Members' use only, with the exception of visiting Yachtsmen from other
Clubs visiting Colne Yacht Club. These Yachtsmen
must sign the visitors' book immediately
on arrival. All persons using the Jetty do so at their
own risk. 2. The use of the Jetty in
connection with any commercial activity is strictly prohibited; i.e..,
fishing and boating parties, sales demonstrations or
anything associated with monetary gain. 3. Vehicles are not allowed
on Jetty and road trailers must be removed after launching. 4. Dinghies and C.Y.C.
launching trolley must be stored in allocated racks and dinghies must not be dragged over Jetty decking under any circumstances.
All dinghies to be removed when not in frequent
use. The C.Y.C. cannot accept any responsibility
for property stored on Jetty or in their
buildings. 5. Boat
maintenance, i.e.,
painting, cleaning and repairs, must not be carried out on Jetty. 6. Swimming and fishing from
the Jetty is strictly prohibited. 7. Tenders must only be moored
for short periods
behind the Hammerhead. (The seaward face
should be left clear for larger craft.) 8. Larger craft (maximum
40ft.) using seaward face must limit their stay to approximately 15 minutes
if it is required for use by other Club members
and at no time must large craft be left unattended. 9. Members have authority to
police the Jetty, see the above Rules are strictly
adhered to, and ask trespassers to leave the Jetty. 10. Any craft unrecognised
as that of a Member or bona fide visitor to the Club will be removed. 11. Children under eight years
of age must be under the supervision of adults when
on the Jetty. 12. Users of the Jetty should
do so with consideration
to other members and visitors. Any infringement
of the above rules will be brought to the notice of General
Committee. 13. Outboard engines to be
left in their working position and not lifted whilst
alongside the Jetty.
